By signing up with us and being a Client, you agree to be legally bound by these Terms and Conditions of Use, including those terms and conditions incorporated by reference. House of Publisher may revise these Terms and Conditions at any time by updating this posting. You should visit this web page periodically to review the Terms and Conditions. All services provided by House of Publisher and all text, images, photographs, user interface, "look and feel", data and other content included from time to time are referred to as the "Website" and/or "Service."
You acknowledge and agree that House of Publisher shall have the right (but not the obligation) in its sole discretion to pre-screen, refuse or remove any project and/or user-provided content that violates these Terms and Conditions or is otherwise objectionable.
1. House of Publisher Technicalities
(a) Description. The House of Publisher Service is an online offering where Clients can post specific assignments and project descriptions, including illustrative samples or other media ("Creative Brief"), revise those briefs ("Revision Brief") and obtain responses ("Response") from the experts retained by House of Publisher.
(b) Creative Brief and Responses. You are solely responsible for preparing and posting detailed descriptions of each of your Creative Briefs to the website, including any relevant deadlines. House of Publisher is under no obligation to review a Creative or Revision Brief for any purpose.
(c) Reviewing Responses. When House of Publisher provides you with a Response, you are responsible for reviewing it. If you fail to promptly inform House of Publisher that the Response is not reasonably responsive, you will be deemed to have accepted it.
(d) Revision Cycles. Revision cycles generally consist of 2–6 additional compositions that incorporate changes you request in a Revision Brief. By the third revision request, your requests shall be modifications of the current composition only.
2. Eligibility, Access, Use and Service
(a) Eligibility. To register as a Client, you must be at least 18 years of age, agree to these Terms and our Privacy Policy, and complete the registration procedure.
(b) Authorization to Use. You may access and use the Service solely in accordance with these Terms and any posted policies. Any use of the website is at your sole risk and responsibility.
(c) Prohibited Uses. Except as expressly permitted, you may not broadcast, circulate, distribute, download, perform, publish, rent, reproduce, sell, store, transmit or create derivative works from the website. You agree to comply with all applicable laws in connection with your use of the Service.
(d) Website Security. You are prohibited from violating or attempting to violate the security of the website, including accessing data not intended for you, probing or scanning vulnerabilities, or interfering with service to any user.
(e) Operation of Website. House of Publisher shall not be responsible for any delays, interruptions, errors or omissions contained in the website, and may at any time discontinue the website in whole or in part.
3. Refund, Cancellation & Tax Policy
The House of Publisher refund policy will be nil if:
- You have chosen a special package.
- The primary design concept has been approved.
- You have demanded revisions.
- The cancellation has been made due to reasons not related to the company.
- The company has not been contacted for more than 2 weeks of project.
- Company policies have been violated.
- Another company or designer has been approached for the same project.
- The creative brief is lacking required information.
- A complete design change has been demanded.
- The claim has crossed the given 'request for refund' time span.
- The business is closing or changing name or business.
- Reasons such as 'change of mind' or 'disagreement with partner' do not qualify for refund.
- For a service bundle, refund will only apply on the dissatisfied service, not the entire bundle.
- The client will not be entitled to any refunds after 7 days from the date of purchase.
- Services such as Social Media, SEO, Domain Registration and Web Hosting are not refundable.
- Refunds will not be entertained once the website design is approved and sent for development.
An order can be cancelled within 7 days of purchase for eligible reasons only. If cancelled within the first 24 hours, 15% of the invoice amount will be retained as cancellation charge. If cancelled after 24 hours, 25% will be retained. Cancellation requests are accepted via email.
Payments made by Visa, Mastercard, and Amex are processed by our bank merchant services. House of Publisher does not hold customer card details on its systems. We also accept payments via cheque, bank transfers, PayPal, and Discover Card. All prices are exclusive of any applicable taxes.
4. Important Information
How do I qualify to claim a refund? When you receive initial design concepts for your design package and you do not find them according to your brief, you may choose to claim a refund within 24 hours of the initial delivery, provided no revisions have been requested.
How long does it take to claim a refund? It can take up to 21 business days to refund your amount.
Does the money back guarantee apply to all packages? Money Back Guarantee applies to design packages only. Once you approve a design and ask for further revisions, the Money Back Guarantee becomes void; however, you still qualify for our 100% satisfaction guarantee.
Money Back Guarantee does not apply on: Content Writing, SEO Services, Marketing Support Services, Telephone Services, Publication, Website Inventory, Script Writing, Marketing / Guaranteed Sales, and Audio Book.
5. Ownership; Rights to Use
(a) Website and Service Generally. House of Publisher owns all right, title and interest in and to all copyright, trademark, service mark, patent, trade secret or other intellectual property rights in and to the website and Service.
(b) Creative and Response Briefs. Upon submission of Client Information, House of Publisher and its agents shall have all rights and licenses necessary to use such information for the purpose of obtaining Responses and for archival purposes.
(c) Rights of Clients. Subject to your compliance with these Terms, you shall own the final Response composition provided to you (the "Final Product"). You shall not, however, own any materials generated during revision cycles leading up to the Final Product.
(d) House of Publisher holds the right to charge your account for $10 pertaining to the release of the final files upon order closure, and reserves the right to bill your account for the release of the website domain or website master files.
6. Nondisclosure and Privacy
House of Publisher intends to use commercially reasonable efforts to follow its privacy policy, as such privacy policy may be changed from time to time. Notwithstanding the foregoing, House of Publisher cannot and does not assume any responsibility or liability for any information submitted to the website or for the use or misuse of any information submitted by you or any other person.
7. Disclaimers; Indemnification; Limitations of Liability
(a) Responsibility for Content. House of Publisher shall not be responsible for any use that is or is not made of the website or the Service and makes no representations regarding the truthfulness, accuracy, or reliability of any information communicated through the Service.
(b) Links to Third-Party Services. The website may contain links to third-party websites or other services. The Linked Content is not under the control of House of Publisher, and we are not responsible for it.
(c) Disclaimer of Warranties. The Service and the Responses are provided "AS IS." House of Publisher makes no representation or warranty of any kind whatsoever relating in any way to the website, including any part thereof.
(d) Release from Claims. If you have a dispute with one or more users, you release House of Publisher (and our affiliates, agents and employees) from claims, demands and damages of every kind.
(e) Indemnification. You agree to defend, indemnify and hold harmless House of Publisher from any action, claim, demand, or liability arising from or relating to your violation of any of these Terms or use of the website.
(f) Limitation of Damages. In no event shall the company be liable for consequential, incidental, special, exemplary, punitive, or indirect damages. House of Publisher's total liability for damages shall be limited to the total amount you paid for your package. This agreement shall be governed by the laws of the United States.
